LAC STE. ANNE COUNTY A YEAR IN REVIEW #6
This is the 6th segment in LSARA's Year in Review. As
we go back through all the requests that we have submitted to LSAC and the
responses we have received, it generates more and more questions. One of
the areas where you, the Ratepayer can assist us. Searching for information,
gathering information as it takes a team, an army. When we as Ratepayers
are once again faced with the call to action, that is what we will need, an
army.
There are areas that are current and some that are lagging that may
force us into an additional petition. LSARA needs to be prepared and we
need you with us. None of us hope that it ever gets to that point again,
but it may. So always being prepared to take the next step is what is
important.
To continue our information series, we are now on question
#12.
QUESTION #12 - What is the status on the warrant and
repairs of the LSAC building? What are the noted deficiencies? What is
the timeline to have all deficiencies corrected and what is the plan if not
fixed by this time frame? Reiterating that it is with legal will not
suffice. This building has been and will continue to be contentious for
the Ratepayers of this County and they deserve to know how their asset is being
preserved and repaired.
LSAC Response - The County and Casman agreed to
extend the warranty period for one year. In July of 2019, Casman will
work with the County to correct all warranty work.
Had LSARA responded, we would have asked why was the only
financial recourse that we had given away by releasing the last million dollars
on the building? The construction hold back for deficiencies caused a
lien to be placed on the building for a million dollars. We can defend
that by proving deficiencies. Where is our recourse now? There are ZERO
dollars held back so HOW do we fix this? Serious structural concerns,
serious. Cracking floors, walls, foundation concerns.....
QUESTION #13 - What is the status of the LUB? (Land
use Bylaw)
LSAC Response - The Land Use Bylaw regulates the use,
conservation, and development of land, habitat, buildings, and signs in pursuit
of the objectives of the County's statutory plans. An ongoing review
process insures the LUB remains current and responsive. Amendments to the
Land Use Bylaw are occurring on a regular basis.
Had LSARA responded, well we would have identified how the
LUB has been an ongoing process for a number of reasons. The lack of
bylaw enforcement to enforce existing bylaws has created some of the perceived
need for change. Some of it has arisen as a result of some members of
LSAC wanting to pursue their own business interests and creating change to
facilitate this.
The latest LUB meeting that took place, Joe Public
Ratepayer was not invited. Only those with properties where they intend to
allow RV's. Only those that live in the subdivisions that they are
looking to redistrict. Only those where they are looking to allow mobile
homes that are older than 20 years old. The message is they will still have to
pass inspection. That is all well and good but can they be INSURED?
That is a potential risk to the homeowners that may be beside them if
they have no insurance and a fire happens for example that affects more than
just that residence, who pays for that? Just a question, we get it that
it is all about affordability in these challenging economic times but there has
to be reason attached to all of these decisions.
It was stated that all
the neighboring Counties and Summer Villages with which LSAC shares borders and
has IDP's (Inter development Plans) were contacted and they had no
concerns. LSARA can tell you that we have contacted some of those very
same neighbors and they have great concern. The concern lies with a
number of issues.

QUESTION #14 - What is the status of Repario
resources bankrupt gravel pit? How much is owed to LSAC?
LSAC Response- Lac Ste. Anne County is in
contact with the Receiver and Manager of Repario Resources Corp. appointed by
the Court of Queen's Bench of Alberta. In January of this year, the
Appointed Receiver began the sale process of Repario Resources
properties. Administration is not in a position to release details of
account balances of any property owner. However, some information has
been made available by the Appointed Receiver on Deloitte's website at:
Had LSARA responded, we would have asked at what point did
LSAC realize that this was a possibility? Is there a bond in place that
restores the land to its original state? Will they get the land
back? Can they resell it? It is a safety risk as it currently sits so who
is responsible to manage the open pit? So many questions .....
